Anatoa.com Terms & Conditions
Effective date: May 28, 2009
The Anatoa.com Terms & Conditions govern the use of the Anatoa.com web site and associated Web Services between Univalence Ltd ("Anatoa") and users of Anatoa's services, applying separately to each account using Anatoa.com.
Service Commitment
Anatoa will use commercially reasonable efforts to make Anatoa.com web site and associated web services available with a service uptime percentage of at least 99.9% during any monthly or yearly billing cycle.
Sharing of Contributed Information
By sharing any contribution (including any text, photographs, or profile information related to fraudulent users) with Anatoa you agree to grant to Anatoa, free of charge, permission to use the material in any way it wants (including modifying and adapting it for operational and editorial reasons). Anatoa may also share your contribution with its other users, for the purpose of alerting them to potential fraudulent activity.
Affiliate Program
1) All Anatoa members (Affiliates) can participate in our affiliate program by using the assigned "Affiliate URL". Anatoa will track referrals through this Affiliate URL using web browser "cookies". If the web browser is unable to accept cookies, Anatoa will not be able to track or register a valid referral. Anatoa will track member registrations made up to 90 days after the affiliate URL has been clicked.
2) Spam: Under no circumstances can you send commercial electronic mail messages as defined in the US Federal spam law, the CAN-SPAM Act of 2003, with respect to Anatoa's affiliate program. Anatoa reserves the right to collect, withhold, or cancel any and all compensation related to the content you send via commercial electronic mail messages.
3) You can not purchase search engine keywords or domain names that use the word "Anatoa" and/or certain variations and mispellings thereof. You can not purchase or register keywords, Pay Per Click advertising, AdWords, search terms, domain names, or other identifying terms that include the word "Anatoa" or certain variations and mispellings thereof for use in any search engine, portal, sponsored advertising service or other search or referral service.
4) Payment: Anatoa will pay the affiliate 20% of all net payments received from affiliate's recruits with respect to Anatoa's subscription service. To protect Anatoa from possible chargebacks and disputed Paypal payments, the affiliate commission is applied 30 days after Anatoa receives payment.
5) Payout: Payouts are made monthly, at the end of the calender month, for commissions accrued during the month. If the outstanding commission balance is less than US $100, the commission will not be paid out, and instead rolled over to the next month. Payments will be made by PayPal only.
6) The term "Affiliate" does not imply any formal association with Anatoa or Univalence Ltd other than that described in this agreement.
7) Any government liability on the amount of commission received from Anatoa, including income tax, national insurance and any other tax imposed by your state or nation of residence, will be the Affiliate's sole responsibility. Anatoa reserves the right to request and maintain sufficient detail, as necessary, to satisfy accountancy regulations in whichever country the Affiliate resides.

To the extent permitted by law, Anatoa excludes all representations and warranties (whether expressed or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. Anatoa does not guarantee the timeliness, completeness or performance of the website or associated web services or any of the content. While we try to ensure that all content provided by the is correct at the time of publication no responsibility is accepted by or on behalf of Anatoa for any errors, omissions or inaccurate content on the website or associated web services.
Anatoa shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of Anatoa.com or associated web services regardless of the form of action.
These terms shall be governed by and interpreted in accordance with the laws of England and Wales which shall have exclusive jurisdiction over any disputes.
